Conspiring to suppress information and deny freedom of speech to vendors and consumers alike is routine in business. Often the corporation with the most money to hire the most lawyers wins. Only a vigilant citizen democracy can save our basic freedoms (not to mention our health and well being).

MONSANTO WANTS TO MAKE RBGH LABELING ILLEGAL: This week, Monsanto declared war on dairy companies that have chosen to ban the injection of their cows with Monsanto’s genetically engineered Bovine Growth Hormone (rBGH). Due to escalating consumer demand, an increasing number of large dairies around the U.S. have declared themselves rBGH-free in the last couple of years. Monsanto, the sole producer of the synthetic hormone, has seen substantial losses in sales as a result of this voluntary movement of the industry towards healthier milk. Although rBGH is banned in most industrialized nations, including Europe and Canada, due to its links to breast and colon cancer, the controversial drug remains legal in the U.S. This week, Monsanto filed a formal complaint with the FDA and Federal Trade Commission, demanding that labeling of rBGH-free diary products be made illegal.

On a more positive note, sometimes the good guys win against corruption and collusion in the revolving door between certain industries and government agencies.

MAD COW SAFETY TESTS LIKELY TO INCREASE THANKS TO USDA LOSING LAWSUIT: Creekstone Farms has won one of the most bizarre court cases the USDA has brought upon itself in recent years. Early last year, after the discovery of another case of Mad Cow Disease in the U.S., foreign markets tightened their ban on U.S. beef based on the fact that the USDA requires such a small percentage of meat to be tested for this fatal disease. In an attempt to maintain sales with customers overseas, Kansas-based Creekstone Farms announced it would voluntarily test all of its meat for Mad Cow Disease. Surprisingly, the USDA responded to Creekstone, saying it was illegal for them to have such high quality food safety testing. This action left Creekstone and its lawyers scratching their heads trying to figure out where in the law books it states that it’s illegal to test food for safety beyond what is required by law. Creekstone took the USDA to court and last week a federal judge ruled against the USDA. The results of the case will likely create a domino effect in the industry where more meatpackers will voluntarily choose to increase testing for Mad Cow Disease in order to allure international and domestic customers. Is it out of the question to envision meats in future supermarkets bearing the voluntary label “This meat has been tested for Mad Cow Disease”?

This report would be funny if it wasn’t about the institution that is supposed to be promoting your health, yet does more to support VIOXX than it does to support peer reviewed evidence of substantial health benefit. The irony of this is that it is as bad for business as it is for the American people. This kind of PR could reduce drug company stock prices.

FDA Threatens To Raid Cherry Orchards

As Americans struggle to eat a healthier diet, the FDA has taken draconian steps to suppress information about foods that reduce disease risk.

While various agencies of the federal government encourage us to eat more fruits and vegetables, the FDA has issued an edict that precludes cherry companies from posting scientific data on their websites. This censorship of published peer-reviewed studies denies consumers access to information that could be used to make wiser food choices…

On October 17, 2005, the FDA banned information about cherries’ health benefits from appearing on websites. The FDA sent warning letters to 29 companies that market cherry products. In these letters, the FDA ordered the companies to stop publicizing scientific data about cherries. According to the FDA, when cherry companies disseminate this information, the cherries become unapproved drugs subject to seizure. The FDA warns that if those involved in cherry trafficking continue to inform consumers about these scientific studies, criminal prosecutions will ensue…

Do Cherries Prevent Cancer?

In a warning letter to Friske Orchards of Ellsworth, MI, the FDA recites the following information contained on this orchard’s website:

“Tart cherries may reduce the risk of colon cancer because of the anthocyanins and cyanidin contained in the cherry.”

The FDA goes on to say in its warning letter:

“These claims cause your product to be a drug as defined in section 201(g) . . . Because this product is not generally recognized as safe and effective when used as labeled, it is also defined as a new drug in section 201(p) . . . Under section 505 of the Act (21 USC 355), a new drug may not be legally marketed in the United States without an approved New Drug Application . . .”

Interestingly, the FDA is not denying the veracity of this information. Instead, it insists that a new drug application has to be approved before the public can be informed about the scientific data supporting cherries. The FDA also asserts, without any basis, that cherries “have not been recognized as safe and effective when used as labeled.” According to the FDA’s interpretation of the law, cherry growers are engaged in criminal conduct by relaying findings that have been published in peer-reviewed scientific journals. Whether you or other Americans develop cancer does not appear to be a consideration …

BTW, having great results on energy with the Harmony Chips despite diagnosed Chronic Fatigue. Can Eli Lilly be Held Criminally Liable for Zyprexa?

California Attorney, Ted Chabasinski, is calling for the criminal prosecution of Eli Lilly executives for hiding the adverse effects of Zyprexa, based in part on articles last month in the New York Times which quote internal company documents that revealed that Lilly knew about the adverse effects for a decade but kept the information hidden.

Mr Chabasinski, appeared by teleconference in US District Court for the Eastern District of New York, on January 3, 2007, before Judge Jack Weinstein, on behalf of MindFreedom, a non-profit human rights organization, in response to a motion by Lilly basically filed to keep the incriminating information hidden, to defend the public’s right to know the contents of the secret Lilly documents concerning Zyprexa.

Mr Chabasinski told the judge that the documents are evidence of Lilly executives’ “criminal behavior” and “willingness to kill people for profit.”

The court granted MindFreedom’s request for more time to respond to Lilly’s motion, and another hearing is set for January 16, 2007. Meanwhile Judge Weinstein said that he was taking “no position” about those people who were not named but who already have copies of the Lilly files on Zyprexa.

Prior to the hearing, in a letter to the judge, Mr Chabasinski pointed out that while the underlying case in which the documents were under seal is civil, the documents reveal criminal behavior on the part of Lilly’s executives. “They have chosen a course of action,” he told the judge, “lying about and hiding the real effects of Zyprexa, that they knew would lead to the injury and death of literally thousands of people.”

“If this isn’t criminal,” he stated, “I don’t know what is.”

The company documents also show that Lilly engaged in a massive illegal off-label marking campaign to get primary care physicians to prescribe Zyprexa for uses never approved by the FDA to increase profits.

The studies in adults with Zyprexa that Lilly submitted to the FDA demonstrate, as far as I can establish, a higher death rate on Zyprexa than on any other anti-psychotic ever recorded. David Healy M.D.

The National Academy of Sciences (NAS) has released its long anticipated report on the human health effects of perchlorates, a byproduct of rocket fuel. Perchlorates, which are a common pollutant near military sites, have recently BEEN FOUND IN DRINKING WATER IN 35 STATES AS WELL AS IN 93 PERCENT OF LETTUCE AND MILK.

Along with the report, the Environmental Protection Agency (EPA) has set drinking water standards indicating that perchlorates are roughly TEN TIMES MORE TOXIC to humans than the Department of Defense has been claiming. Perchlorates can inhibit thyroid function, cause birth defects and lower IQs, and are considered particularly dangerous to children. Monitoring wells across the U.S. are now finding perchlorate levels as high as 30,000 times what the EPA indicates would be safe exposure.

About 85% of medicine is not evidence based, despite protestations of medical boards and physicians. The effectiveness of flu vaccines is one of the areas where evidence is most lacking. Opinion, assertion, and bombastic pronouncements without solid evidence to support clinical statements is pervasive.

The only thing that is well documented about flu vaccines is some of their negative side effects. This problem is now reaching the medical journals. Is this the next menopausal hormone therapy or VIOXX myth to be exploded?

Death by Medicine

Something is wrong when regulatory agencies pretend that vitamins are dangerous, yet ignore published statistics showing that government-sanctioned medicine is the real hazard.

Until now, Life Extension could cite only isolated statistics to make its case about the dangers of conventional medicine. No one had ever analyzed and combined ALL of the published literature dealing with injuries and deaths caused by government-protected medicine. That has now changed.

A group of researchers meticulously reviewed the statistical evidence and their findings are absolutely shocking. These researchers have authored a paper titled “Death by Medicine” that presents compelling evidence that today’s system frequently causes more harm than good.

It is now evident that the American medical system is the leading cause of death and injury in the US. (By contrast, the number of deaths attributable to heart disease in 2001 was 699,697, while the number of deaths attributable to cancer was 553,251.)

CDC puts genetic sequences of about 40 human H5N1 viruses into public domain

(CP) – Scientists at the U.S. Centers for Disease Control have placed the genetic blueprints of about 40 H5N1 viruses isolated from human bird flu cases in Indonesia into one public access database.

They will log the huge new collection into another database as well, the director of the agency’s influenza division said Monday.The move to put the data in the public domain, giving scientists from around the world free access, came after the Indonesian government told the World Health Organization on Thursday that it was willing to share the genetic sequences of all H5N1 viruses isolated from humans there.

“We feel this is a public health problem of global proportion and that therefore it is in the best interest of global public health to have the data available for as many creative minds and well-trained minds as possible,” Dr. Nancy Cox, director of the CDC’s influenza division, said in an interview with The Canadian Press.

Viruses have a set of seven frequencies and the bird flu virus frequency set for the strain in the photo above is:

The gold stained items are the bird flu in the photo and several of the frequency components can be seen, i.e. 336765 (gold circles with white center), 265366 (gold fuzzy ellipses), and 155376 (gold rods). The highest frequency can be found in human cells infected with the virus of which there are none in the photo. The other frequencies are related to protein components not evident in the photo.

Each viral strain needs to be targeted separately and frequency sets need to be developed for the other 39 strains in the CDC database.
